The Law on electronic labour has passed

On December 16, 2019, Vladimir Putin signed a law amending the Labor Code of the Russian Federation (RF LC). The document provides for the preparation of information on labour activity in electronic form. From January 1, 2020, employers are required to enter information on employment, employees’ positions and other necessary information online in a special system of the Pension Fund (PFR).

Employers’ actions

To implement the new rules, the document provides for the following activities by employers during 2020:

  • introduce amendments to agreements and collective agreements and (if necessary) to local regulations;
  • ensure technical readiness for the transfer of information on labour activity in electronic form to the Pension Fund of the Russian Federation;
  • notify employees in writing about these changes to labour law by June 30.

From January 1, 2020, employers are required to submit monthly information until the 15th day of the next month on the labour activities of the insured persons to the PFR (accepting, transferring, dismissing, and also choosing the form of a labour book keeping: in electronic form or on paper). From January 1, 2021, such information will have to be submitted no later than the next working day. Forms for the provision of information on employees’ labour activities will be approved by the PFR and published on the fund’s website.

Paper labour books

Those employees who have paper work books will be entitled to submit an application to the employer for their keeping and filling in. In this case, the data on the employment records of such employees will be recorded both in the PFR system and on paper. For first-time job applicants, from January 1, 2021, information on labour activities will be carried out only in electronic form.
Providing information about labour activity to an employee
The law establishes ways for an employee to get information about labour activity on paper or in electronic form. In particular, they can be obtained from the employer at the last place of work, including upon dismissal, at the multifunctional center for the provision of state and municipal services, in the PFR and/or using the Unified portal for State and municipal services.
