Increased penalties for violation of packaging disposal in Russia

In June 2019, changes regarding payment of the environmental levy in Russia came into effect. The environmental levy is paid by importers and producers of goods if they fail to comply with recycling standards.

For whom is the environmental levy relevant?

The list of goods subject to recycling is quite extensive with 54 groups of goods, including textiles, clothing, electrical appliances, household appliances, and various types of packaging. The full list is given in the Regulation of the Government of the Russian Federation of December 28, 2017 N 2970-r.

Companies producing or importing these goods must choose one of these options regarding the disposal of goods:

  • Recycle these goods after they lose their consumer properties on their own in compliance with the recycling norms
  • Conclude an agreement with an official, licensed company specializing in recycling
  • Pay an environmental fee for pollution
What changes have occurred?

Firstly, since June 17, 2019, fines for violation of the reporting procedure have been increased:

  • From RUB 3,000 to 6,000 for officials
  • From RUB 70,000 to 150,000 for legal entities

Secondly, the fines for providing inaccurate reports were increased:

  • From RUB 3,000 to 6,000 for officials
  • Doubled, but not less than RUB 250,000 for legal entities

Additionally, a fine for failure to pay the fee within the time limit was introduced:

  • From RUB 5,000 to 7,000 for officials
  • Three times the amount of the unpaid fee, but not less than RUB 500,000 for legal entities

The statutory deadline for payment of the levy is April 15 of the year following the reporting year.
Secondly, the government plans to change the calculation of the environmental levy, expanding it to include a list of information on goods that are not ready for use or for which there is no obligation to comply with recycling standards.
