Russia | Resumption of the experiment on the use of electronic documents related to work

According to the Ministry of Labour and Social Protection of the Russian Federation (hereinafter – the “Ministry of Labour”), from April 19, 2021, it is planned to resume companies’ connection to the experiment on HR electronic document management. Applications can be submitted until May 15. The pilot project is extended until November 15, 2021, with the subsequent amendments to the Labour Code of the Russian Federation.

Currently, the draft order “On amendments to the Regulation on the procedure for conducting an experiment on the use of electronic documents related to work” is undergoing public discussion in the State Duma.

The experiment of the Ministry of Labour makes it possible to implement HR electronic document management with employees without duplicating paper documents. At the same time, regardless of the type of digital signature (an encrypted and certified digital signature – CDS, or an encrypted non-certified digital signature – NDS), which the employee used to sign, the HR documents are considered legal.

Joining the experiment can be done at the company’s request; no fees of any kind are required. NDS using saves companies the time and money needed to issue CDS. The HR documents signed with the NDS are of the same importance as those ones signed with the CDS.

The experiment on the use of electronic documents related to work is carried out in accordance with the Federal Law of April 24, 2020 No. 122-FZ “On conducting an experiment on the use of electronic documents related to work” and the order of the Ministry of Labour of Russia dated May 14, 2020 No. No. 240n “On approval of the Regulation on the procedure for conducting an experiment on the use of electronic documents related to work”.
