Coming soon: registration of a trademark, service mark, or appellation of origin in the EAEU with one application

Now it is possible to register a trademark, service mark, and appellation of origin, the protection of which will extend throughout the territory of the EAEU member states.

On August 19, 2020, the Government of the Russian Federation approved the draft federal law “On the ratification of the Treaty on Trademarks, Service Marks and Appellations of Origin of Goods of the Eurasian Economic Union” and brought it before the State Duma of the Russian Federation.

After ratification of the Treaty, it will be possible to obtain legal protection of a trademark, service mark, and appellation of origin (hereinafter – “means of identification“) on the territory of all EAEU states by submitting one application to any national patent office of an EAEU member state. An application for registration will be drawn up according to uniform requirements, regardless of which state agency it is submitted to. The decision on registration will be made based on the results of an examination in each patent office of the EAEU countries. The fee for submitting an application will be set individually by each EAEU member state.

The advantages provided by the Treaty can be used not only by companies which register means of identification for the first time, but also ones whose rights have already been registered in the territory of some EAEU states, or which submitted national applications on the date when the Treaty entered into force.
