Updated Rules of Procedure in Arbitration Courts

On June 30, 2020, the Supreme Court of the Russian Federation adopted two resolutions No. 12 and No. 13, explaining the rules of court proceedings in the appellate and cassation instances in arbitration courts that deal with disputes related to business activities.

In particular, these resolutions explained the provisions of the Arbitration Procedure Code concerning the following procedural issues:

  • categories of participants entitled to appeal under the appeal and cassation proceedings;
  • judicial acts subject to appeal and cassation appeal;
  • the procedure and terms for filing appeals and cassation appeal, their acceptance;
  • term, order, limits of consideration and powers of the court of appeal and cassation instances.

The uniform application of the provisions by arbitration courts will help to make the judicial process more predictable at the stages of appealing the decisions of the first instance courts in the second (appeal) and third (cassation) instances. This should help improve the investment climate in Russia.
