The Law introduces changes to the procedure for setting job quotas for the disabled
On July 1, 2021, the Federal Law on amendments to the law “Concerning Employment in the Russian Federation” (hereafter – the “Law”) and Article 21 of the Federal Law “On the Social Protection of Disabled Persons in the Russian Federation” came into force. A number of its provisions will take effect on March 1, 2022.
According to Article 25 of the Law, employers are obliged to post information on the need for human resources, employment conditions, vacant jobs/positions and specially equipped work places for the disabled on a unified digital platform or other information resources. From July 1, 2021 the Russian government regulates the procedure for providing such information.
From March 1, 2022 the issues of job quotas for the disabled will be regulated by the Law instead of the Federal Law on the Social Protection of Disabled Persons. In this connection Article 13.2 was introduced to the Law which establishes the number of employees for calculating quotas for hiring disabled people. The lawmakers specified that the average number of employees for these purposes does not include employees with harmful and/or hazardous working conditions and employees of branches and representative offices in other subjects of Russia. At the same time, employers must take into account regional requirements for job quotas in branches and representative offices. The quota obligations will be fulfilled when the employer and the employee duly formalize their employment relationship. Previously it was sufficient to allocate a workplace within the quota and not refuse to hire a disabled person on grounds not related to special qualification requirements.
