Liability for violation of the self-izolation period and spread of fake news about COVID-19

Based on the new legislation from April 4, violators of sanitary-epidemiological rules face the following punishments:

Violation of sanitary-epidemiological rules in an emergency situation regime, or by threat of spread of the disease or quarantine, or failure to comply with the order of sanitary doctors can be punished as follows:

  • for citizens:
    • Administrative fine of RUB 15,000 to 40,000;
  • for company officials
    • Administrative fine of RUB 50,000 to 150,000;
  • for unincorporated private entrepreneurs
    • Administrative fine of RUB 50,000 to 150,000; or
    • Administrative suspension of activities for up to 90 days;
  • for companies:
    • Administrative fine of RUB 200,00 to 500,000;  or
    • Administrative suspension of activities for up to 90 days

Violation of sanitary-epidemiological rules which caused mass disease or created a threat of mass disease can be punished as follows:

  • for citizens:
    • Criminal fine of RUB 500,000 to 700,000: or
    • Deprivation of the right to hold certain positions for 1-3 years; or
    • Restriction of the citizen’s freedom up to 2 years; or
    • Compulsory labour for up to 2 years; or
    • Imprisonment for up to 2 years.

Violation of sanitary-epidemiological rules which caused reckless death of a person can be punished as follows:

  • for the citizen:
    • Administrative fine of RUB 150,000 to 300,000;
    • Criminal fine from RUB 1,000,000 to 2,000,000; or
    • Restriction of the citizen’ freedom for 2-4 years; or
    • Compulsory labour for 3-5 years; or
    • Imprisonment for 3-5 years;
  • for company officials
    • Administrative fine of RUB 300,000 to 500,000; or
    • Disqualification for 1-3 years;
  • for unincorporated private entrepreneurs
    • Administrative fine of RUB 500,000 to 1,000,000; or
    • Administrative suspension of activities for up to 90 days;
  • for companies:
    • Administrative fine of RUB 500,000 to 1,000,000; or
    • Administrative suspension of activities for up to 90 days.

Violation of sanitary-epidemiological rules which caused reckless death of two or more persons can be punished as follows:

  • for citizens:
    • Compulsory labour for 4- 5 years; or
    • Imprisonment for 5-7 years.

Spread of fake news can be punished as follows:

  • for the company:
    • Administrative fine of RUB 1,500,000 to 3,000,000; with /without
    • Administrative forfeiture of the object of violation;
  • for the citizen:
    • Criminal fine – from RUB 300,000 to 700,000; or
    • Restriction of freedom for up to 3 years.

Spread of fake news which caused injury to health can be punished as follows:

  • for companies:
    • Administrative fine of RUB 3,000,000 to 5,000,000;
  • for citizens:
    • Administrative fine of RUB 300,000 to 400,000 (for repeated violations); with /without
    • Administrative forfeiture of the object of violation;
    • Criminal fine of RUB 700,000 to 1,500,000; or
    • Imprisonment up to 3 years.

If spread of fake news which caused death of a person, this action can be punished as follows:

  • for companies:
    • Administrative fine of RUB 3,000,000 to 5,000,000;
  • for citizens:
    • Administrative fine of RUB 300,000 to 400,000 (for repeated violation); with /without
    • Administrative forfeiture of the object of violation;
    • Criminal fine of RUB 1,500,000 to 2,000,000; or
    • Imprisonment up to 5 years.

Spread of fake news which crippled the functioning of life support facilities, transport or social infrastructure, credit organizations, energy, industry or communications can be punished as follows:

  • for citizens:
    • Administrative fine of RUB 300,000 to 400,000 (for repeated violation); with /without
    • Administrative forfeiture of the object of violation;
  • for company officials:
    • Administrative fine of RUB 600,000 to 900,000;
  • for companies:
    • Administrative fine of RUB 5,000,000 to 10,000,000

THE MOSCOW CITY DUMA ACCEPTED THE CHANGES TO THE LAW OF MOSCOW

Based on these changes, the failure to comply with the requirements for a temporary suspension of events with the presence of citizens, as well as the work of other public organizations can be punished as follows:

  • for company officials:
    • Administrative fine of RUB 30,000 to 40,000;
    • Administrative fine of RUB 40,000 to 50,000 (for repeated violation);
  • for companies:
    • Administrative fine of RUB 200,000 to 300,000;
    • Administrative fine of RUB 300,000 to 500,000 (for repeated violation).

Violation of self-isolation and violation of the requirements of normative acts of Moscow can be punished as follows:

  • for the citizen:
    • Administrative fine of RUB 4,000;
    • Administrative fine of RUB 5,000 (for repeated violation);
    • Administrative fine of RUB 5,000 (in case of using a transportation vehicle).
