Changes in Russian migration legislation

There have been significant changes in Russian migration legislation concerning the labour activity of highly qualified specialists (HQS).

On 10 July 2023, Federal Law No. 316-FZ was published amending Federal Law No. 115-FZ of 25 July 2002 "On the Legal Status of Foreign Citizens in the Russian Federation". Most new provisions have already entered into force. According to one of the new regulations effective from 1 March 2024, the minimum salary rate of an HQS shall increase from RUB 501 thousand to RUB 750 thousand per quarter.

The new law regulates for the first time the timeframe for obtaining a work permit. From now on, an HQS is obliged to collect the issued work permit within 30 calendar days from the date of the decision to issue it, otherwise the permit will be annulled.

Amendments to the Federal Law also regulate the involvement of an HQS in labour activity in the Russian Federation, permitting documents and terms of length of stay in the country in case of dismissal.
